Watershed Appliance also reserves the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. If your order is canceled after your credit card has been charged, we will issue a credit to your credit card in the amount of the charge. If product is marked "in stock" and not available, you will be notified within 48 hours.

Pricing

Credit Card Charges

Watershed Appliance currently uses PayPal which is recognized as one of the worldwide leaders in secure e-commerce payment technologies and services. Your credit card is charged when your order is placed. If in case, your item is on backorder you may request to have the charges reversed until the package ships via contacting our customer service department at 877-644-0414.

Rebate Disclaimer

Most rebates on the site are offered through our manufacturers. These rebate and coupon offers are subject to the terms specified by the manufacturer. These terms include the timeframe of the offer, limitations on quantities and combination with other offers. Proof of purchase and UPC codes from the original packaging are normally required for redemption of rebates by the manufacturer or the manufacturer's agent.

Limitations & Exclusions

Online sales are intended for, and limited to, personal use and domestic sales only. We reserve the right to limit the number of products sold, including the right to prohibit sales to re-sellers. We disclaim all responsibility for the accuracy of any map or direction presented on our website. We will not ship to foreign locations. Warranties for products that are exported will be null and void.

Risk of Loss

All items purchased from Watershed Appliance are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Cardholder Agreement

When you make purchases from Watershed Appliance using your major credit card, you agree to honor the terms and conditions of your cardholder agreement. Watershed Appliance is not responsible for items lost in shipping (see "Risk of Loss")

Applicable Law

By visiting Watershed Appliance, you agree that the laws of the state of Texas, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Watershed Appliance, or its affiliates.

Disputes

Any dispute relating in any way to your visit to Watershed Appliance or to products you purchase through Watershed Appliance shall be submitted to confidential arbitration in Carrollton, Texas, except that, to the extent you have in any manner violated or threatened to violate Watershed Appliance's intellectual property rights, Watershed Appliance may seek injunctive or other appropriate relief in any state or federal court in the state of Texas, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Modification, and Severability

We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Product Warranties

Warranty information is noted on each product. Most items have a manufacturer's warranty for either operational, cosmetic or both. For these items you will need to contact the manufacturer directly for warranty length, conditions and to schedule service. If there is no manufacturer's warranty available we will offer a 90 day operational warranty in the continental United States only starting from the day the item was delivered. We will either repair or refund your money. You will need to contact us directly if service is needed. Lastly some items do not have any warranty. These items are sold as-is, any repairs would be done at your expense.

Shipments

All of our shipments are 100 percent insured. It is very important to inspect your product thoroughly before accepting and signing for it. Unlike smaller purchases, appliances are delicate and have many parts that are sensitive to rough handling. Though your box and packaging may appear intact, it is still possible that your product may be damaged. Check for both internal and external damage before accepting delivery. If you notice there is damage to the product, refuse the package and note the damage on the delivery invoice. Please call our customer service department immediately, and we will issue a return authorization (RA) number. If damage issues arise after signing for the merchandise, you are responsible for filing all claims with the shipper. Therefore, a thorough inspection of all packages is important before signing. Most items ship with in two business days after receiving your order using qualified carriers such as FedEx® and Estes®. Carriers will deliver to driveway or front door only at ground level (no steps). Delivery appointment window is normally 4 hours.

Condition of product

All products are marked with a condition. For example new, display, damaged and used. We make every effort to include as much information as possible in the description and actual pictures of out-of-box items. Submit any requests to us if actual out-of-box pictures are not available or if you have additional questions. We want to give you piece of mind about your purchase; no surprises.
